Welcome to WanderKid. By creating an account or using the app, you agree to these Terms of Service. Please read them carefully. If you do not agree, please do not use the app.

1. About WanderKid

WanderKid is a children's storytelling application that generates personalised stories with audio narration and optional illustrations using artificial intelligence. WanderKid is operated by Nambiar Enterprises, based in the United Kingdom. The app is designed for children aged 3 to 10 and must be set up by a parent or legal guardian.

2. Account Registration

You must be at least 18 years old (or the age of majority in your jurisdiction) to create a WanderKid account. By creating an account, you confirm that you are a parent or legal guardian and that any child profiles you create are for children under your care. You are responsible for all activity under your account and for maintaining the security of your login credentials.

3. Acceptable Use

WanderKid is designed for families to enjoy age-appropriate storytelling. You agree not to:

• Attempt to circumvent content safety measures or generate inappropriate content.
• Use the app for any commercial purpose, including reselling generated content.
• Attempt to reverse-engineer, copy, or extract any part of the app's technology.
• Share your account credentials with others or allow unauthorised access.
• Use the app in any manner that violates applicable laws or regulations.

4. AI-Generated Content

All stories, narration, and illustrations in WanderKid are generated by artificial intelligence. While we employ comprehensive safety measures to ensure all content is age-appropriate and wholesome, AI systems may occasionally produce unexpected results. We encourage parents to enjoy stories alongside their children, particularly with younger age groups.

Generated stories are created for your personal, non-commercial use. You may share stories with family and friends but may not publish, distribute, or sell generated content commercially without written permission from WanderKid.

5. Subscriptions and Payments

WanderKid may offer free and paid subscription tiers. Paid subscriptions are billed through the Apple App Store. By subscribing, you agree to the pricing and payment terms presented at the time of purchase.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage and cancel subscriptions through your Apple ID account settings.
• Refunds are handled in accordance with Apple's refund policies.
• We reserve the right to change subscription pricing with reasonable notice. Price changes will not affect your current billing period.

6. Fair Usage

To ensure a quality experience for all users, WanderKid may implement fair usage limits on story generation, narration, and illustration requests. These limits vary by subscription tier and are designed to prevent abuse while providing generous allowances for normal family use. Current limits are displayed within the app.

7. Service Availability

We strive to keep WanderKid available at all times, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance. We are not liable for any loss or inconvenience caused by service interruptions.

8. Intellectual Property

The WanderKid app, including its design, code, mascot (Cosmo), branding, and all associated materials, is the intellectual property of WanderKid and is protected by applicable copyright and trademark laws. You may not copy, modify, distribute, or create derivative works based on any part of the app without written permission.

9. Your Content and Data

Child profile information and preferences you provide are used solely to personalise the storytelling experience. You retain ownership of the information you provide. Our use of your data is governed by our Privacy Policy, which forms part of these Terms.

10. Disclaimer of Warranties

WanderKid is provided on an "as is" and "as available" basis. While we work hard to deliver a high-quality, safe experience, we make no warranties, express or implied, regarding the app's reliability, accuracy, completeness, or fitness for a particular purpose. AI-generated content may contain errors or inconsistencies. We do not warrant that the app will be error-free or that defects will be corrected within any specific timeframe.

11. Limitation of Liability

To the fullest extent permitted by applicable law, WanderKid and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to loss of data, loss of revenue, or emotional distress. Our total liability for any claim arising from these Terms or your use of the app shall not exceed the amount you paid for WanderKid subscriptions in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless WanderKid, its operator, and any affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or your misuse of the app.

13. Termination

We may suspend or terminate your access to WanderKid at our discretion if we believe you have violated these Terms. You may terminate your account at any time by deleting it in the app (Settings → App → Delete account) or by contacting us. Upon termination, your right to use the app ceases immediately, and we may delete your account data in accordance with our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or via email. Continued use of the app after changes constitutes acceptance of the revised Terms. If you do not agree with the changes, you should stop using the app and contact us to delete your account.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of WanderKid shall be subject to the exclusive jurisdiction of the courts of England and Wales.
